The property comprises a site of 0.28 acres with two detached single storey buildings, one of approximately 180 square metres and the other of 92 square metres. The boundary of the property extends to the pavement at the front and there is currently parking space for several cars.
A planning pre-application was made in October 2018 which indicated that ‘two 2-storey apartment buildings (potentially eight apartments in total) ...or a terrace of eight, or two terraces of three or four semi-detached properties may be appropriate…’ and ‘the layout will need to provide adequate parking (at least 2 spaces per dwelling) and satisfactory private amenity space (rear
Gardens) for each property.’
The advice also states: ‘You have submitted additional information regarding the existing use of the buildings that would be demolished and lost as a result of developing this site. New development of this site would result in the loss of these community facilities. In order for a proposal to be supported, details will be required to be submitted to demonstrate how this loss will be compensated for elsewhere and details provided of the alternative venue available for these existing uses and activities.

RELEASE OF COVENANTS AND REMAINING RIGHTS AND EASE
Buyers will see in the legal pack that the property has had various restrictive covenants which would prevent buyers from developing the site.
The seller’s solicitor has advised that the significant restrictive covenants have been removed and redevelopment of the site is now possible, subject to planning permission.
The small area between the substation and the road cannot be built on as access to the substation and underground cables is required.

C3: The 1984 conveyance reserves to the Council the right to use the drains which may run under the land tinted yellow on the title plan.
C4: The 18.10.99 conveyance and deed of grant allowed the parking of vehicles on the parking area alongside the pavement. This has now been released except for the area coloured green on the site plan in this brochure and edged yellow on the aerial photo. This release now allows a vehicular access to be constructed into the site from the road, subject to planning permission. The deed also granted a right of access from the road to the electricity sub-station for the Council and Marches Housing Association.
C5: The 23.11.99 transfer and deed of grant transferred the rights of access to the sub-station to Midland Electricity PLC. The document imposes new covenants as set out in clause 5 thereof. These prohibit the erection of any building on the land affording access to the sub-station and any interference with Midland Electricity PLC’s apparatus.
C6: The land tinted blue on the title plan is subject to a reservation of identical rights to those set out in C3 above.
C7: The 2021 deed released the covenants contained in the 1965 and 1984 conveyances mentioned at C1 and C2.

2. Deposit of £1040 which goes towards the purchase price of the house
In addition to this, the buyer will be responsible for paying Cooper Green Pooks' administration fee of £3,600 including VAT. This is payable within 24 hours of the close of the auction and buyers should contact Cooper Green Pooks to make this payment.
DEFINITION OF AUCTION RESERVE AND GUIDE PRICE
The guide price is an indication of the seller's expectation. Reserve price is a figure below which the auctioneer cannot sell the lot at auction. The reserve will be set either below the guide price or no more than 10% above the guide price. Guide prices and reserve prices may change at any time prior to the auction.
