Description
The opportunity to purchase the Former St Mary’s Church, benefitting from a good-sized plot, and offers a semi-rural location. The property serves in our view as an opportunity for developers and could be utilised for a range of uses (subject to planning permission). Situated in the village of Llanfaglan, located circa 3 miles from the historic castle town of Caernarfon, offering a wide range of amenities such as; Supermarkets, Surgeries, Banks, Schools, Restaurants and more.
The property shown edged red on plan A (Included within the legal pack) must not be used for:
· Manufacture, distribution or sale of alcohol.
· Religious use.
· Immoral, sacrilegious, offensive or noisy purposes; use for the occult or psychic mediums; use as a club; weddings.
The purchaser must agree:
· The property must cease to be called St Mary Magdalene’s Church and shall not be called by any name that is associated with its use as a church or the dedications 'Mary Magdalene’ or ‘Mary’ or ‘Magdalene’.
· To comply with all planning and other relevant legislation.
In relation to the graveyard shown edged green on plan B (Included within the legal pack) the purchaser must agree:
A. To keep the area as open space as a graveyard and to use it for no other purpose. No materials or vehicles including any gardening machinery or tools shall be stored upon the graveyard.
B. To permit access to and not interfere with any legitimate visitors to graves during daylight. The Vendor’s decision as to who is a legitimate visitor shall be final. Where any building works are carried out, including excavation, the purchaser shall ensure that public access to graves is not obstructed without the Vendor’s agreement.
C. Not to permit any animals onto the graveyard and to ensure that dogs or other animals in the ownership of the purchaser or anyone associated with the purchaser are secured such that visitors to graves are not frightened or intimidated.
D. Not to decorate or in any way interfere with any gravestones or monuments and to keep the graveyard and all walls gravestones and monuments in good and tidy condition such that access for visitors is not obstructed or interfered with. The purchaser shall monitor the condition of the gravestones and monuments and consult the vendor if any represent a safety risk so that permission and instruction on remedying any problem can be provided.
E. The purchaser shall also agree to adhere to the Church in Wales’s faculty regulations under the control of the Diocesan Court for any works to alter or move gravestones if required to do so by the Vendor and to be bound by its decision or any decision of an appeal court. There shall be no exhumation of remains unless the requirements of the Disused Burial Grounds (Amendment) Act 1981 or other burial ground legislation that may apply are fulfilled. Notice of any application under the 1981 Act shall be copied to the Vendor. If approval is obtained under the Act, or a license for exhumation is granted, to provide evidence of the appropriate authority to the Vendor.
F. Not to excavate any of the land included in the sale without obtaining all appropriate permissions and consents including those required under acts of parliament or local or national statutory instruments. The Disused Burial Grounds (Amendment) Act 1981 applies to any building works and the purchaser will need to take legal advice to ensure familiarity with the details.
The covenants listed above (A-F) do not apply to the land shown hatched green on plan B (Included within the legal pack).
If the property is sold to another party (the acquiring party), the purchaser will enter into a contract with the acquiring party and the Representative Body to the effect that the acquiring party will accept and uphold the covenants contained in the original conveyance and incorporate the same clause in the terms of any contract with any successive purchaser.
The purchaser will be responsible for meeting surveyors and solicitors’ fees or any other reasonable costs incurred as a result of any variation, licence or contract relating to any of the above conditions.
In relation to the land edged red, but excluding that edged and hatched green (Included within the legal pack)
Overage: The successful purchaser agrees to enter into an overage agreement and to pay the vendor 30% of the increase in value should planning permission be obtained for development of the associated land and grounds within the next 25 years.
In relation to the property edged red on Plan A (Included within the legal pack)
The purchaser must agree: Where the building is unlisted, to give the vendor notice of any proposal to remove where present any remaining stained glass, fonts, altars, organs, bells, wall memorials or plaques from the property. The items must be offered to the vendor who must be given three months from the date of removal to respond and collect the items.
